Remote Support Terms of Service
Effective September 23, 2026
1. Agreement to these terms
These Remote Support Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and Clear Choice Technical Services, LLC ("Clear Choice," "we," "us"). By purchasing a subscription, checking the box at checkout, typing your name as an electronic signature, or using the Services, you agree to these Terms. If you are accepting on behalf of a business or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
If you do not agree to these Terms, do not purchase or use the Services.
2. Definitions
- "Services" means the remote computer support services described in Section 3 and in your selected Plan.
- "Plan" means the subscription tier you select (Single Seat, Business, Enterprise or Custom), including the number of Covered Devices and features listed for that tier at the time of purchase.
- "Covered Device" or "Seat" means one desktop or laptop computer registered to your account.
- "Billing Cycle" means the period for which you prepay: monthly, every six months, or annually.
- "Session" means a single remote support engagement in which a Clear Choice technician connects to a Covered Device with your permission.
3. Description of Services
Subject to these Terms and your Plan, Clear Choice will provide remote technical support for Covered Devices, which may include:
- Diagnosis and resolution of operating system, software and configuration issues;
- Virus, malware and unwanted software removal;
- Installation, updating and configuration of software you are licensed to use;
- Printer, scanner, Wi-Fi and basic network connectivity troubleshooting;
- Email, account and password assistance;
- New computer setup assistance and data transfer guidance; and
- Additional features listed for your Plan at the time of purchase.
Support is provided by phone, email, chat and remote access during our published support hours. Response times are targets, not guarantees, unless a specific service level is set out in a written Custom Plan agreement.
4. Exclusions
Unless expressly included in your Plan or agreed in writing, the Services do not include:
- On-site visits, hardware diagnosis requiring physical access, hardware repair or replacement parts;
- Data recovery from failed, damaged or encrypted storage media;
- Support for devices that are not registered as Covered Devices;
- Custom software development, website management or server administration;
- Issues caused by unlicensed, pirated or unsupported software, or by devices that no longer receive security updates from the manufacturer; and
- Training beyond what is reasonably necessary to resolve a support request.
Excluded work may be available as separate break/fix service at our then-current rates, with your prior approval.
5. Plans, seats and fees
Fees are based on your Plan and Billing Cycle as displayed at checkout. Discounted rates for six-month and annual Billing Cycles apply only when the full Billing Cycle is prepaid. Each Plan covers up to the number of Covered Devices listed for that Plan; adding devices beyond that number requires an upgrade to a larger Plan or a Custom Plan.
Additional computers at checkout. You may add Covered Devices at checkout at your Plan's per-computer rate for your selected Billing Cycle, up to the limit shown at checkout. These devices are billed, renewed and price-locked together with your Plan.
Add-on Seats. Where offered, you may add Covered Devices to your Plan at a discounted add-on rate, up to the limit shown at the time of the offer. Add-on Seats are billed for the same Billing Cycle as your Plan, are charged to your payment method on file when added, co-terminate and renew automatically with your Plan at the add-on rate then in effect, and are subject to the same cancellation and refund terms. Plans requiring one hundred or more Covered Devices are available only as Custom Plans.
You may replace a Covered Device (for example, when you retire an old computer) by notifying us. Seats may not be shared among more devices than your Plan allows at any one time.
All fees are in U.S. dollars and exclude applicable sales, use or similar taxes, which will be added where required by law.
6. Billing and payment
Fees for each Billing Cycle are charged in advance on the first day of that Billing Cycle to the payment method you provide. You authorize Clear Choice and its payment processors to charge your credit card, debit card or bank account for all fees due under these Terms.
Card payments
You represent that you are authorized to use the card you provide. If your card is updated or replaced, we may receive updated card information from your card issuer's account updater service.
Bank account (ACH) payments
If you pay by bank account, you authorize Clear Choice to initiate electronic debit entries to the account you provide for the amount shown at checkout and, for each renewal, for the fee for your Plan and Billing Cycle as determined under Section 9. This authorization remains in effect until you cancel your subscription or revoke the authorization by notifying us at least three (3) business days before the next scheduled debit. Debits that are returned for insufficient funds or other reasons may be re-presented as permitted by the NACHA Operating Rules, and a returned payment fee may apply where permitted by law.
Failed payments
If a payment fails, we will notify you and may retry the charge. If payment is not received within ten (10) days of the due date, we may suspend the Services until your account is brought current.
7. Automatic renewal
Your subscription renews automatically. At the end of each Billing Cycle, your subscription will automatically renew for another Billing Cycle of the same length, and your payment method will be charged the fee for your Plan as determined under Section 9, unless you cancel before the renewal date as described in Section 8.
For six-month and annual Billing Cycles, we will send a reminder to the email address on your account at least 15 days and no more than 45 days before the renewal date, stating the renewal date, the amount to be charged and how to cancel. We will provide notice of any material change to your subscription terms before it takes effect.
By completing checkout, you acknowledge that you have read this automatic renewal disclosure and affirmatively consent to recurring charges on these terms.
8. Cancellation and refunds
You may cancel your subscription at any time by calling (866) 620-2287, by contacting support, or through any online cancellation method we make available. Cancellation stops future renewals.
- Monthly plans: cancellation takes effect at the end of the current month. You will not be charged again.
- Six-month and annual plans: to avoid renewal, cancel at least thirty (30) days before the renewal date. Service continues through the end of the prepaid Billing Cycle.
Because prepaid Billing Cycles are discounted, fees paid for a Billing Cycle that has started are non-refundable, except where a refund is required by law or where we terminate the Services without cause under Section 17. If you cancel within the first seven (7) days of your very first Billing Cycle and have not used the Services, you may request a full refund.
9. Price lock and price changes
Your price is locked for three years. Your rate is protected under the schedule below for as long as your subscription stays active without interruption.
- Years 1 through 3: the price for your Plan and Billing Cycle, including any additional computers and Add-on Seats purchased when you signed up, will not increase. Computers added after signup are billed at the rates in effect at that time.
- Years 4 and 5: we may adjust your price, but it will not exceed the retail (list) price for your Plan and Billing Cycle in effect on your original start date.
- After year 5: your subscription renews at our then-current market rates for your Plan.
Years are measured from your original subscription start date. Any permitted change takes effect at the start of your next Billing Cycle, and we will notify you at least thirty (30) days in advance. If you do not agree to a change, you may cancel before it takes effect. If you cancel and later resubscribe, then-current rates apply. Moving to a different Plan starts a new price lock period for the new Plan. Taxes and government fees are not covered by the price lock.
10. Upgrades, downgrades and billing changes
You may upgrade to a larger Plan at any time. Upgrades take effect immediately, and the unused portion of your current Billing Cycle will be credited toward the new Plan. Downgrades and changes to your Billing Cycle take effect at your next renewal date.
11. Your responsibilities
To receive the Services, you agree to:
- Provide accurate account, contact and billing information and keep it current;
- Maintain current backups of your data before and during any Session;
- Hold valid licenses for all software installed on Covered Devices;
- Provide reasonable access, cooperation and administrative credentials needed to resolve an issue;
- Use the Services only for Covered Devices you own or are authorized to manage; and
- Not use the Services for any unlawful purpose.
12. Remote access and consent
Remote Sessions are initiated only with your permission. By starting a Session, you authorize our technician to access and control the Covered Device for the purpose of resolving your request. You may observe the Session and end it at any time. Our technicians will limit their access to what is reasonably necessary to perform the Services and will not intentionally access, copy or modify personal files unrelated to your request.
You acknowledge that troubleshooting may require installing or removing software, changing settings or restarting devices, and that some changes may affect other software or data.
13. Data privacy and confidentiality
We treat information we encounter during a Session as confidential and use it only to provide the Services. We collect and use your personal information as described in our Privacy Policy. We do not sell your personal information.
Business transfers
If Clear Choice Technical Services, LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of its business or assets, your account and customer information, including profile details, portal activity, rewards history and any social media profile links you choose to add, may be transferred to the successor or acquirer as part of that transaction. Any successor will be required to honor the commitments in these Terms and our Privacy Policy for the information transferred. We will notify you of a change of ownership that affects how your information is used.
Profile information you share
If you add social media profile links or other public profile details to your Clear Choice portal profile, you consent to Clear Choice storing them, displaying them to other customers where your profile is public, and using them as described in these Terms, including in a business transfer. You can remove them at any time in your portal settings.
We never store your full card number or bank account number on our systems; payment information is handled by our PCI-compliant payment processor. You are responsible for complying with any laws or regulations that apply to the data on your devices, including any industry-specific requirements.
14. Third-party products
The Services may involve third-party software, including remote access tools and software we install at your request. Third-party products are governed by their own license terms, and we make no warranty regarding them.
15. Warranties and disclaimers
We will perform the Services in a professional and workmanlike manner consistent with generally accepted industry standards. If we fail to do so, your exclusive remedy is for us to re-perform the affected Services at no additional charge.
EXCEPT AS STATED IN THIS SECTION, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR CHOICE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT EVERY ISSUE CAN BE RESOLVED REMOTELY, THAT THE SERVICES WILL BE UNINTERRUPTED, OR THAT ANY DEVICE WILL BE FREE OF VULNERABILITIES OR MALWARE.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR CHOICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
17. Term, suspension and termination
These Terms remain in effect for as long as you have an active subscription. We may suspend or terminate the Services if you materially breach these Terms and fail to cure the breach within ten (10) days of notice, if payment is overdue as described in Section 6, or if we reasonably believe your use of the Services is unlawful or abusive. We may also terminate the Services for any reason with thirty (30) days' notice, in which case we will refund the unused prepaid portion of your fees.
Sections 13 through 16 and 19 through 22 survive any termination.
18. Indemnification
You agree to indemnify and hold harmless Clear Choice and its employees from claims arising out of your breach of these Terms, your violation of law, or your use of software you are not licensed to use, except to the extent caused by our negligence or willful misconduct.
19. Electronic signatures and communications
You agree that typing or drawing your signature and checking the acceptance boxes at checkout constitutes your electronic signature and has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law. You consent to receive this agreement, receipts, renewal reminders and other notices electronically at the email address on your account. You may request a paper copy of these Terms at no charge by contacting us, and you may withdraw consent to electronic communications by cancelling your subscription.
20. Dispute resolution and governing law
If you have a concern, please contact us first; most issues can be resolved quickly and informally. These Terms are governed by the laws of the state in which Clear Choice maintains its principal place of business, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in that state, except that either party may bring an individual claim in small claims court where eligible.
21. Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, including natural disasters, widespread internet or power outages, acts of government, labor disputes or cyberattacks on third-party infrastructure. Payment obligations are not excused by this section.
Intellectual property
The Services, the Clear Choice portal, the Clear Choice web and desktop applications, and all related software, source code, designs, content, trademarks and documentation are the proprietary property of Clear Choice Technical Services, LLC and its licensors, and are protected by copyright, trademark and other laws. Your subscription gives you a limited, non-exclusive, non-transferable right to use them for your own business during your subscription. You may not copy, modify, distribute, sell, reverse engineer or create derivative works from them. Ideas and feedback you share may be used by Clear Choice without obligation to you.
22. General
These Terms, together with your order details and any written Custom Plan agreement, are the entire agreement between you and Clear Choice regarding the Services. If a Custom Plan agreement conflicts with these Terms, the Custom Plan agreement controls. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
23. Changes to these terms
We may update these Terms from time to time. If we make a material change, we will notify you by email at least thirty (30) days before it takes effect. Changes will apply starting with your next Billing Cycle. If you do not agree to a change, you may cancel before it takes effect.
